Abstract

In this article, I will try a critical look from the theory of the state, and in particular from an anarchist perspective to three problematic questions for the analysis and the critique of the contemporary juridical-political systems. At first, the relationship between the stated purpose and the material results of custodial sentences. At second, the real role of custodial sentences in the context of the political system and of third, the critical view that is appropriate for the analysis of these issues. To do this, I will begin with a more or less objective description of the formulation of the purposes of the custodial sentence under liberal criminal law.
